In this Ethics CLE, former OED attorney Emil J. Ali will provide a brief introduction to the USPTO’s Office of Enrollment and Discipline (OED) and will explain how to ensure compliance with the USPTO Rules of Professional Conduct. Trademark attorneys are often unaware, until it is too late, that their conduct may not comport with the technical requirements, including regarding signatures, declarations, specimens, and more. Such violations may then implicate the USPTO’s ethical rules and lead to discipline. Based on his experience investigating misconduct within OED, and now representing practitioners before OED, Emil will provide best practices for how to avoid common pitfalls in trademark practice.
