Reuters (August 12, 2020) — Michael McCabe’s career in intellectual property law – and his special niche in IP ethics – has taken him in and out of Big Law, academia, boutique firms and his own solo shop in Washington D.C., McCabe Law, which he ran for the last three years.  Now he is launching a new firm with Emil Ali, a lawyer on the other side of the country with experience on both sides of the practice – including investigating and prosecuting attorney misconduct at the U.S. Patent and Trademark Office.

McCabe and Ali this week debuted McCabe & Ali, a bicoastal boutique dedicated to representing IP practitioners, firms and others facing regulatory scrutiny, investigations and enforcement actions.

In this Ethics CLE, former OED attorney Emil J. Ali will provide a brief introduction to the USPTO’s Office of Enrollment and Discipline (OED) and will explain how to ensure compliance with the USPTO Rules of Professional Conduct. Trademark attorneys are often unaware, until it is too late, that their conduct may not comport with the technical requirements, including regarding signatures, declarations, specimens, and more. Such violations may then implicate the USPTO’s ethical rules and lead to discipline.
